If you’ve been accused of Exploitation of the Elderly, it’s important to know that you have rights. You can count on me to be your experienced criminal defense lawyer when facing fraud or exploitation charges.
Many exploitation cases involve finances and happen when an elderly or disabled person is manipulated into signing over significant amounts of money or property, or their assets have been stolen. There are new laws in place surrounding the abuse, neglect, or exploitation of an elderly person or disabled adult which increase penalties for crimes against elders.
How is “elderly” defined?
An “elderly person” is defined as a person 60 years of age or older who is suffering from advanced age or organic brain damage, or other physical, mental, or emotional impairment that inhibits the ability for that person to provide adequate self-care. A “disabled adult” is defined as a person 18 years of age or older who suffers from physical or mental incapacitation due to a developmental disability, organic brain damage, or mental illness, or who has one or more physical or mental limitations that restrict their ability to perform the normal activities of daily living and care.
Accusations of exploitation involve complex and emotionally charged issues, so it’s critical to work with a knowledgeable and skilled criminal defense lawyer with extensive experience in cases like these.
